Who the chapter addresses
Chapter 13 provides a repayment-plan process for eligible individuals with regular income. A sole proprietor may qualify as an individual, but a corporation or partnership does not file under Chapter 13. Eligibility and debt limits require current verification.
The plan and the household
Plans commonly run for three to five years under the statutory framework. Income, expenses, property, secured debt, and priority obligations all matter to the analysis. The court must approve the plan, and completing payments is part of the process rather than an automatic consequence of filing.
Useful preparation
Make a household budget that distinguishes regular income from uncertain income. Bring debt statements and property records, and clearly label any business activity. Ask counsel to explain affordability, required payments, alternatives, and the consequences if circumstances change.
